Terms & Conditions 

  • Hua Hin Stay and other affiliate websites are operated under Stay Group Co., Ltd. located on 226 Phaholyothin Road, Samsen Nai, Phayathai, Bangkok 10400 Thailand, here in after referred as “the Lessor”.
  • Customer whose name and detailed information are successfully processed through Hua Hin Stay.com, here in after referred to as “The Tenant”, “The Renter” or “Guest”.

General

  • No additional charges for electricity and water usage will be levied, in the case of daily rental. For rental periods exceeding 20 nights, electricity charges will be the renter's responsibility (according to actual usage as indicated on the meter). The electricity charge will be collected in cash at the rate of 6.00 or 9.00 Baht net per unit (per the room description).
  • Following completion of the reservation and payment process through the website, the lessor agrees to provide the serviced apartment or property as requested by the tenant.
  • Prior to starting the lease and before the tenant may enter the property, the lessor shall be notified and will receive full payment from the tenant.
  • The tenant must first acquire the key at the Lessor’s office and present the rental confirmation and identification documentation. The key shall be returned to the same location on the date of departure.
  • Pictures and detailed service facilities and amenities as described in the website shall be available upon tenant’s check-in. The lessor reserves the right not to notify should any modification or service maintenance be made to the properties or facilities.
  • The tenant shall provide truthful information while interacting or making bookings with the lessor through the website. False information or any fraudulent activities will be rejected or result in cancellation from the lessor without notification and refund.
  • The lessor shall provide secured web transactions, data encryption and payment through the website. The lessor will utilize the payment gateway service from trusted operator therefore; the tenant is subjected to the payment gateway operators’ terms and conditions. The lessor reserves the right not to compensate for any damages that arises herein.
  • The lessor shall provide secure accommodation to the facilities according to Thailand’s safety standard for service apartment. The tenant should inform the lessor immediately should there be any failure of the facility and safety. Otherwise there is an understanding by both parties, that the services provided by the lessor have fully met its standard.

Insurance

  • By accepting the properties and term and conditions, the renter, hereby, assumes and accepts all risks and accidental damages at the tenant’s own responsibility.
  • The tenant understands that personal accident or injury cannot be claimed or compensated from the lessor. The tenant is highly recommended to purchase personal accident (PA) insurance or travel insurance prior to entering the property.
  • The renter may be able to claim compensation for damage due to accident as per the lessor has insured to the third party insurance company. Only if this type of accident is caused by force of nature, plumbing leakage, smoke and fire. No compensation can be reimbursed beyond the coverage.
  • Insurance will not cover damage to the properties and tenants arising from unusual activities or misconduct.
  • There is no insurance for the damage or repair to the furniture (such as sofa, bed, mattress and cabinet) and fixtures (such as window, door frame, mirror, and shower) and electronic appliances (such as TV, refrigerator, and air conditioning units). Tenants assume full responsibility and shall be charged for misuse of these items except for normal wear and depreciation of normal usage. Therefore, the lessor shall repair such broken items in a timely manner.

Payment & Refund

  • In order to secure the reservation, the tenant must complete the full payment process, through the lessor’s online secured payment gateway, at least 2 days prior to start of rental period. The lessor will provide the confirmation number to the tenant. All rates are calculated in Thai Baht and includes VAT.
  • The rental fee includes:
  1. Occupancy of the property for the specified time period
  2. Standard utilities, electric appliance, fully equipped kitchen, and/or Internet service (as described in the room description on the website)
  3. Bed linens and towels sufficient for stated number of guests in the confirmation voucher and not exceeding maximum allowable guests.
  4. Marrakesh Only (and other applicable properties) - Cleaning service twice a week as scheduled, and prior to check-in. Please check the room description on the website.
  5. Use of property’s facilities such as swimming pool, fitness room, garden, lobby, car park. Some  properties may require additional payment to gain access or for usage of the facilities.
  • Additional bed linens and towels requested are not included in the rental fee and will incur additional fees (each time item is laundered/replaced by the Lessor):

  • The Lessor requires a refundable key deposit of THB 2,000 for stays not exceeding 7 nights and THB 5,000 for stays exceeding 7 nights during check in. This deposit will be refunded to the guest during check out.
  • On check in, room change requests from guests will not be accommodated by the lessor.
  • There will be no refund for unused days or in case customer leaves the properly before the end of contract.
  • The Lessor will not be responsible for any personal belongings left behind by the Guest upon check out.
  • No refund will be provided for any type of promotion booking purchased through the website.  For cancellations outside of 30 days prior to arrival date, 10% administrative fee will be deducted from the full amount before refunding to the tenant. Please note that any changes in rental dates become a new rental agreement. Payment is fully non-refundable in case of cancellation within 1 week prior to arrival date or no show.
  • The refund process will take approximately 30 working days and the money will be transferred into the customer’s bank account or refunded into the credit card used for the booking. Please note that the customer is responsible for any bank transfer fees or any expenses incurred.

Property Regulations

  • Tenant agrees to abide by the Rules and Regulations of the property. If the tenant breaches them, the building management has the right to inform local authorities, give warnings or fines, terminate the usage/access of the property or other measures as deemed appropriate.
  • Tenant agrees that the number of people occupying the property at one time will not exceed the maximum occupancy number indicated on the confirmed reservation. The lessor shall not be responsible for any problem arising during a rental in which the number of persons occupying the property exceeds the maximum occupancy provided herein.
  • Where it is found that the number of guests exceeds the maximum stated occupancy, the Lessor reserves the right to terminate rental without refund and/or charge additional fees at the Lessor’s discretion
  • The tenant will personally occupy the property for said dates and shall not sub-let the property under any circumstances.
  • Pets are strictly not allowed. If found, the Tenant shall remove it immediately, at his/her own expense or the Lessor may terminate rental without refund.
  • The tenant agrees not to smoke or allow visitors to smoke inside the property or in the common areas of the building of which the property is a part. Smoking is allowed outside the buildings, balcony, gardens (when indicated as permissible by notice at the property). The tenant will agree to have full responsibility and pay applicable extra charges for the failure to follow the regulations and set off the fire alarm.
  • Smoke detectors are installed inside the room for safety. Alarms caused by misuse or inconsiderate use of in-room equipment shall be the tenant‘s full responsibility and subject to applicable extra charges.
  • Neither candle lighting nor oil burner is allowed in the rented room for safety reasons.
  • Energy savings is crucial, kindly turn off the electricity and air-conditioning before leaving the room.
  • Renter will keep the apartment clean and dispose left over food/rubbish at the garbage room daily and prior to checking out, otherwise a garbage collection fee of THB 300 will be deducted from the cash deposit.
  • Car park spots are limited to 1 car per unit on a first-come-first-serve bases (check website description) and are controlled by the properties’ Juristic Person/building. The Lessor will not be responsible if car park spots are not sufficient due to uncontrollable factors or  during public holidays or other peak periods.
  • Tenant is restricted to 1 car park per apartment at the Marrakesh Residences. The tenant will require a car park card for entry to/from the Marrakesh Residences, which will be provided on check in. If the tenant requires more car park spots, the tenant will have to contact the building management directly and additional charges may apply.

Equipment Breakdowns

Lost key/Car Park Card/Access Card

  • If the renter loses the key, car park card or property access card of the property, the renter must inform the lessor immediately, and report any damages that occurs on the property during the renter’s stay. For security reasons, the lessor will be required to change the locks. Renter agrees to pay this cost of 5,000 baht. Furthermore, the property access/car park card will be charged at THB 1,000 per card. Please note that the spare key is kept at a different location, which cannot be accessed immediately. The key is secured and cannot be copied for security reason.

In room amenities breakdowns

  • The in room check-list will be proposed to the renter on the check-in and check-out date. The renter agrees to pay the applicable extra charge in case of any damages or losses occurred by the use of the renter.

Building and common areas breakdowns

  • The lessor cannot be held responsible for any breakdown/availability of any equipment/services in the property or any common areas of the building, which the property is a part of (e.g. elevator, swimming pool, fitness room), nor for failure of public utilities (e.g. water, electricity, cable station, internet). Please alert the lessor as soon as problems are identified. Every effort will be used to resolve the problems in a timely manner.
  • If the renter’s preferred room is unavailable due to machine breakdown or interior maintenance, the lessor has the right to change the room without prior notice.
  • After check in, if the renter’s room becomes unlivable due to uncontrollable factors such as in-room equipment failure, the lessor will relocate the renter to another room of similar standard until the issue/breakdown has been resolved.

Photographic Content

  • All pictures on the Lessor’s website are the copyright of the Lessor’s photographer.
  • All in-room pictures, amenities, views, furniture, and property facilities were taken as-is and on-location. No alterations were made to the interior or exterior of the room or pictures except for photographic color and lighting enhancement.
  • Tenants shall bear in mind that it is not possible to take pictures from all angles of the room, amenities, views, furniture, and property facilities. Therefore, the tenant shall make their decision and reserve the room based on the available pictures.

Privacy of individual

  • The tenant must be aware that the properties or facilities are private residences. All activities and behavior must not violate other residents’ privacy and disrupt the good living atmosphere. No loud noise or disturbances to other residents is allowed throughout the properties. The person in charge or security of the properties, have the right to take controllable action toward any disturbance activities. This includes warning notification and termination. No refund will be given if the tenant is in breach of the above condition.

Tenant Nationality

  • The lessor accepts most requests booking from around the world. However, there are some nationalities that the owner of the property is not comfortable to accept rental. This is the choice and private right of the owner, which the lessor does not interfere. Therefore, the following nationalities will not be accepted for reservation; Indian, Bangladesh, African.

Termination

  • If the tenant infringes any section of this agreement, or violates or in breach of any part of this agreement, the tenant agrees that this agreement will be terminated and the tenant agrees to return the key and property immediately. In such case, no refund is granted. The contract shall become binding once payment transaction is completed and shall be governed by and construed and interpreted in accordance with the law of the kingdom of Thailand.
